I just watched a show on urban legends where they said the "went to make a cup of coffee" thing never happened. Sorta like the Darwin awards though. Fun reading. In real litigation news, I was surprised to see Ashcroft push for "maximum provable" sentencing. I like that. A Charlotte, NC lawyer purchased a box of very rare and expensive cigars, then insured them against fire among other things. Within a month having smoked his entire stockpile of these great cigars and without yet having made even his first premium payment on the policy, the lawyer filed claim against the insurance company. In his claim, the lawyer stated the cigars were lost “in a series of small fires.†the insurance company refused to pay, citing the obvious reason: That the man had consumed the cigars in the normal fashion. The lawyer sued........ and won!!! In delivering the ruling the Judge agreed with the insurance company that the claim was frivolous. The Judge stated nevertheless, that the lawyer held a policy from the company in which it had warranted the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be “unacceptable fireâ€, and was obligated to pay the claim. Rather than endure a lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000.00 to the lawyer for his loss of the rare cigars lost in the “fires.†NOW FOR THE BEST PART..... After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!!!! With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000.00 fine. For now I'm simply wearing a colorless-see thru ribbon for all those, who like me need to form an opinon but cant because they too are disenfranchised: as they are also waiting to hear from their state rep or nightly news to tell them how they should think and feel. I think thall those idiots should first go on "Morals Court" then the "Dr. Phil" show and maybe even a psychiatrist, and if they can justify going further, then go to court to sue. People just plainly NEED to get their own morays together and take on their OWN FAULTS. Law suits should only be persued if you can actually prove somebody maliciously or purposely did something to hurt you. What this means is that ("honest") ACCIDENTS DO HAPPEN, and they happen to everybody (ever get a paper cut?) This is part of life and you dshould roll with the punches- so to speak. Put the 'fault' where it is due- even it is with yourself. Remember was that guy who gashed his arm on his Z lately? His own fault, or NIssan's? Even if the motor home guy didn't sue and win a million dollars, he probably did put the car on cruise control and let it go without being at the wheel. Its s**t like this that makes me think I won't be a cop for very long once I become one, because the first S.O.B. that breaks into my house or car and gets hurt and says "lawsuit"... I'm just going to put a bullet in his head. Because I've heard far greater sucess stories in court with people just shooting trespassers and thieves than those where the victim just let them go.
